1.2 These Terms and Conditions (Terms) govern:

1.2.1 your access to and use of our website at sabipets.com.au and any related pages (the Website); and

1.2.2 all orders for, and purchases of, SABI products made via the Website (Products).

1.3 By accessing the Website, browsing, or placing an order, you acknowledge that you have read, understood and agree to be bound by these Terms, together with our Privacy Policy, Shipping Policy, and Returns & Refunds Policy (together, the SABI Policies).

1.4 If you do not agree to these Terms, you must not use the Website or place an order.

2. Intended Geographic Scope

2.1 The Website and its content are intended for access by persons located in Australia.

2.2 We make no representation that the content or operation of the Website complies with the laws of any country other than Australia. If you access the Website from outside Australia, you do so at your own risk and are responsible for compliance with local laws (if and to the extent they apply).

2.3 SABI currently ships within Australia only. We do not offer international delivery at this time.

3. Eligibility and Use of the Website

3.1 By using the Website and/or placing an order you warrant that you:

3.1.1 are at least 18 years of age;

3.1.2 have the legal capacity to enter into a binding contract; and

3.1.3 are accessing the Website from within Australia.

3.2 If you are under 18 or otherwise lack capacity, a parent or legal guardian must place any order on your behalf, and will be deemed to have accepted these Terms.

3.3 You must not misuse the Website, including by:

3.3.1 introducing viruses or other malicious or technologically harmful material;

3.3.2 attempting to gain unauthorised access to the Website or its servers; or

3.3.3 using the Website for any unlawful or unauthorised purpose.

4. Product Information, Availability and Orders

4.1 All descriptions, images and other information regarding Products on the Website are provided for general information and marketing purposes. We take care to ensure accuracy, but minor variations (for example, in colour, surface texture or tone) may occur due to screen settings or the nature of materials.

4.2 Display of Products on the Website does not constitute an offer by SABI to sell; it is an invitation for you to make an offer to purchase.

4.3 By placing an order on the Website, you make an offer to purchase the Products in your basket in accordance with these Terms.

4.4 All orders are subject to availability and acceptance by SABI. We may, at our sole discretion, reject or cancel an order (including after an order confirmation) where:

4.4.1 the Product is unavailable or out of stock;

4.4.2 there has been a genuine error in pricing, description, or other Website information;

4.4.3 we reasonably suspect fraudulent or unauthorised activity; or

4.4.4 the order appears to be placed for resale or commercial purposes rather than personal use.

4.5 If we cancel all or part of your order for any reason set out in clause 4.4 after payment has been received, we will promptly refund the relevant amount to your original payment method.

4.6 We may limit the number of items supplied per customer, per order, or per address, at our discretion. If your order exceeds such limits, we may adjust your order and refund the difference.

5. Pricing and Payment

5.1 All prices on the Website are in Australian dollars (AUD) and include GST, unless otherwise stated.

5.2 We may change prices at any time without notice, however the price payable for your order is the price displayed at the time your order is placed (subject to any genuine website errors under clause 4.4).

5.3 We accept the following payment methods (as updated from time to time):

5.3.1 Visa, Mastercard, American Express, JCB;

5.3.2 PayPal;

5.3.3 Google Pay and Apple Pay;

5.3.4 Afterpay (on orders up to the applicable platform limit).

5.4 Payment must be authorised and cleared before your order is dispatched. If payment is declined or cannot be processed, the order will not be accepted.

5.5 We do not store full credit card details. Payment information is processed securely by third-party payment providers such as Afterpay.

5.6 We may, in our discretion, contact you to request further verification (for example, where there have been multiple failed payment attempts or where the order includes high-value items).

5.7 If we are unable to contact you after reasonable attempts using the details provided, we may cancel your order and refund any amounts paid.

5.8 To the maximum extent permitted by law, SABI is not liable for orders cancelled due to payment failure, declined transactions, or errors by third-party payment providers.

5.9 Afterpay and Klarna are independent services. Their approval or refusal of a transaction is outside SABI’s control. For details, please refer to the terms on afterpay.com.

6. Shipping and Delivery

6.1 SABI currently ships within Australia only. Orders to addresses outside Australia cannot be accepted.

6.2 Shipping costs vary based on your delivery location and the Products in your order. Final delivery fees are calculated and displayed at checkout, in AUD and inclusive of GST.

6.3 Orders placed before 1:00pm AEST typically dispatch on the next business day, subject to stock availability and payment confirmation. Standard delivery time is approximately 5–7 business days from order confirmation.

6.4 Delivery timeframes are estimates only and may be affected by peak periods, public holidays, carrier disruptions or events beyond our reasonable control.

6.5 A signature may be required upon delivery. Risk in the Products passes to you on delivery to the address provided (or when a person at that address signs for the delivery).

6.6 Certain Products (including large, heavy or made-to-order pieces) may require special handling or specific delivery arrangements. Our team will contact you to coordinate these where applicable. Additional charges may apply and will be disclosed to you before confirming the arrangements.

6.7 Further details are set out in our Shipping Policy, which forms part of these Terms. In the event of inconsistency, these Terms prevail to the extent of that inconsistency.

7. Returns, Refunds and Warranty

7.1 Your rights under the Australian Consumer Law

7.1.1 Our Products come with guarantees that cannot be excluded under the Australian Consumer Law (ACL).

7.1.2 You are entitled to a replacement or refund for a major failure, and to have the Product repaired or replaced if it fails to be of acceptable quality and the failure does not amount to a major failure.

7.1.3 Nothing in these Terms, the Shipping Policy, or the Returns & Refunds Policy is intended to exclude, restrict or modify any rights you may have under the ACL or any other law which cannot be excluded.

7.2 Change of Mind

7.2.1 SABI offers change-of-mind returns within 30 days of delivery, subject to the conditions set out in our Returns & Refunds Policy.

7.2.2 Eligible items may be returned for a full refund, exchange or store credit, provided they are unused, unwashed and in pristine condition, with all original packaging, tags, inserts, accessories and message cards.

7.3 Faulty, Damaged or Incorrect Products

7.3.1 If your order arrives faulty, damaged or incorrect, please contact us at customerservice@sabipets.com.au as soon as possible (ideally within 14 days of delivery) with your order number and photographs of the issue.

7.3.2 Where a Product is confirmed to be faulty or not as described, we will provide an appropriate remedy in accordance with the ACL, which may include repair, replacement, refund or store credit.

7.4 Product Condition and Returns Process

7.4.1 Products must be returned in their original, undamaged packaging with all seals, tags and labels intact, unless otherwise agreed or required by law.

7.4.2 Returns must follow the process set out in our Returns & Refunds Policy, which forms part of these Terms.

7.5 Made-to-Order and Customised Products

7.5.1 Made-to-order, customised or bespoke Products are not eligible for change-of-mind returns and may only be returned where they are faulty, not fit for purpose or not as described under the ACL.

7.6 Extended Warranty

7.6.1 Certain Products may be covered by an extended warranty, as described at the time of purchase. Misuse, improper care or normal wear and tear may void such warranty.

8.1 Your privacy is important to us. Our Privacy Policy, available on the Website, explains how we collect, use, disclose and store your personal information.

8.2 By using the Website or placing an order, you consent to the collection and handling of your personal information in accordance with the Privacy Policy.

15.1 These Terms are governed by the laws of New South Wales, Australia.

15.2 You submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts of appeal from them.
